The Bovine Viral Diarrhoea (Wales) (Amendment) Order 2025

The Welsh Ministers, in exercise of the powers conferred by sections 1, 8(1) and 25 of the Animal Health Act 1981(1), make the following Order.

Title and coming into force

1.—(1) The title of this Order is the Bovine Viral Diarrhoea (Wales) (Amendment) Order 2025.

(2) This Order comes into force on 8 May 2025.

Amendment of the Bovine Viral Diarrhoea (Wales) Order 2024

2.—(1) The Bovine Viral Diarrhoea (Wales) Order 2024(2) is amended as follows.

(2) In article 1 (title, application and coming into force), in paragraph (4), for “2025” substitute “2026”.

(3) For the word “supervision”, in each instance where it appears, substitute the word “direction”.

(4) In article 40 (pre-movement testing), in paragraph (2), for “30” substitute “60”.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Bovine Viral Diarrhoea (Wales) Order 2024 (S.I. 2024/753 (W. 105)) (“the 2024 Order”).

Article 2(2) amends the coming into force date of articles 35 to 41 of the 2024 Order from 1 July 2025 to 1 July 2026.

Article 2(3) replaces the word “supervision” with “direction” throughout the 2024 Order to clarify that a veterinary surgeon does not necessarily need to be physically present when a person is taking a sample.

Article 2(4) extends the pre-movement testing window, where an animal is to be moved off a holding, from 30 to 60 days.

The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to this Order. As a result, it was not considered necessary to carry out a regulatory impact assessment as to the likely costs and benefits of complying with this Order.
