The Civil Enforcement of Bus Lane and Moving Traffic Contraventions (County Borough of Merthyr Tydfil) Designation Order 2025

This Order is made in exercise of the powers conferred on the National Assembly for Wales by paragraphs 9(1) and 10(1) of Schedule 8 to the Traffic Management Act 2004 (“the Act”)(1) and now vested in the Welsh Ministers(2).

Merthyr Tydfil County Borough Council has applied to the Welsh Ministers for an Order to be made under these powers with respect to part of that Council’s area(3). The area to be designated under the Order is an area within, or co-extensive with, an area already designated as a civil enforcement area for parking contraventions as required by paragraphs 9(2) and 10(2) of Schedule 8 to the Act.

The Welsh Ministers have consulted the chief officer of South Wales Police in accordance with the requirement set out in paragraph 10(4) of Schedule 8 to the Act.

Title and commencement

1.—(1) The title of this Order is the Civil Enforcement of Bus Lane and Moving Traffic Contraventions (County Borough of Merthyr Tydfil) Designation Order 2025.

(2) This Order comes into force on 6 February 2025.

Designation of civil enforcement area for bus lane and moving traffic contraventions

2.  The Welsh Ministers designate the area described in the Schedule to this Order as—

(a)a civil enforcement area for bus lane contraventions, and

(b)a civil enforcement area for moving traffic contraventions.

Article 2

SCHEDULEArea designated as a civil enforcement area for bus lane contraventions and for moving traffic contraventions

The whole area of the County Borough of Merthyr Tydfil with the exception of—

(a)the entire length of the A4060 from its junction with the A470 Abercanaid roundabout to its junction with the A465 Dowlais roundabout including the circulatory carriageway of the Pentrebach roundabout, Triangle Business Park roundabout and Mountain Hare roundabout;

(b)that length of the A470 from the boundary with the County Borough of Rhondda Cynon Taff at a point approximately 320 metres north of the A470 Abercynon roundabout to the boundary with the County Borough of Rhondda Cynon Taff at a point approximately 895 metres north of the Cefn Coed roundabout including the circulatory carriageway of the Abercanaid roundabout, Rhydycar roundabout and Swansea Road roundabout;

(c)that length of the A470 from the boundary with the County Borough of Rhondda Cynon Taff at a point approximately 351 metres south of the A4054 Upper High Street Cefn Coed junction to the boundary with the County of Powys at Pont-Llysiog; and

(d)that length of the A465 from the boundary with the County Borough of Caerphilly at a point approximately 550 metres east of the A465 Dowlais Top roundabout to the boundary with the County Borough of Rhondda Cynon Taff at a point approximately 13 metres east of its junction with the B4276 Merthyr Road including all slip roads and the circulatory carriageway of the A465/A4060 Dowlais roundabout, A465 Dowlais Top roundabout and Cefn Coed roundabout.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order designates the area described in the Schedule as a civil enforcement area for bus lane and moving traffic contraventions for the purposes of Part 6 of the Traffic Management Act 2004. That area is already designated as a civil enforcement area for parking contraventions under that Act by the Civil Enforcement of Parking Contraventions (County Borough of Merthyr Tydfil) Designation Order 2011 (S.I. 2011/2868 (W. 307)).

The practical effect of the Order is to enable Merthyr Tydfil County Borough Council to enforce bus lane and moving traffic contraventions within the area described in the Schedule to the Order through a civil law regime.

By virtue of section 92(1) of the Traffic Management Act 2004, the National Assembly for Wales was defined as the appropriate national authority as regards Wales for the purposes of Part 6 of the Act. The functions of the National Assembly for Wales under the Act were transferred to the Welsh Ministers by virtue of section 162 of, and paragraph 30 of Schedule 11 to, the Government of Wales Act 2006 (c. 32).
