The Transfer of Functions (Digital Government) Order 2025

MINISTERS OF THE CROWNThis Order in Council is made under sections 1 and 2 of the Ministers of the Crown Act 1975. It makes provision for the transfer of functions under the Public Sector Bodies (Websites and Mobile Applications) (No. 2) Accessibility Regulations 2018 (“the 2018 Regulations”) from the Minister for the Cabinet Office to the Secretary of State. It also makes provision for certain functions of the Minister for the Cabinet Office in Chapters 1, 3 and 4 of Part 5 of the Digital Economy Act 2017 to be exercised concurrently with the Secretary of State. The Order also makes provision for property, rights and liabilities in connection with certain digital functions, or in connection with the transferred functions in the 2018 Regulations, to be transferred from the Minister for the Cabinet Office to the Secretary of State for Science, Innovation and Technology. Finally it makes supplementary provision in relation to those various transfers.

MINISTERS OF THE CROWNThis Order, made under section 2 of the Ministers of the Crown Act 1975, provides for the transfer of property, rights and liabilities from the Home Secretary to the Secretary of State for Housing, Communities and Local Government, in consequence of the transfer of functions in relation to fire and rescue services from the Home Secretary to the Secretary of State for Housing, Communities and Local Government.

CONSTITUTIONAL LAWThis Order paves the way for the Scottish Ministers and a Minister of the Crown to enter into agency arrangements, under which a Minister of the Crown can exercise functions on behalf of the Scottish Ministers in relation to the recognition of non-UK and UK qualifications. Any such arrangements would be agreed between a Minister of the Crown and the Scottish Ministers.

They extend to England and Wales but apply in relation to England only.

LOCAL GOVERNMENT, ENGLANDThis Order makes changes to electoral arrangements for the city of Sunderland following recommendations made by the Local Government Boundary Commission for England. The area of the city remains unchanged. Article 3 abolishes the existing electoral wards of the city of Sunderland and replaces them with the 25 new ones listed in Schedule 1 for the purpose of elections held on or after the ordinary day of election of councillors in England in 2026. It also establishes the names and areas of the new electoral wards and the number of councillors for each.
The Tribunal Procedure (Amendment) Rules 2025

TRIBUNALS AND INQUIRIESThese Rules amend the tribunal procedure rules that apply in the First-tier Tribunal and Upper Tribunal, to expressly provide that the power to set-aside a decision of a tribunal which disposes of proceedings can be exercised by the First-tier Tribunal and Upper Tribunal, either on the application of a party or on the tribunals’ own initiative. These amendments are made to clarify the tribunals’ power to set-aside, following the decision of the Upper Tribunal in MA v Secretary of State for Work and Pensions [2020] UKUT 172 (AAC).

The GPDO provides, for the purposes of section 59 of the Town and Country Planning Act 1990 (c. 8), for the granting of permission for certain classes of development without the requirement for a planning application to be made under Part 3 of that Act.
