term the act The Secretary of State makes these Regulations in exercise of the power conferred by section 2(5) of the Ivory Act 2018(1) (“the Act”).

The Secretary of State, in accordance with section 2(5) of the Act, being of the opinion that the institutions specified in regulation 2(2) have the necessary knowledge and expertise to provide the Secretary of State with advice on applications for exemption certificates and having obtained the consent of the persons in charge of each institution to the prescription of that institution as able to provide such advice, in accordance with section 2(6) of the Act, prescribes those institutions as able to provide such advice to the Secretary of State.

In accordance with section 39(3) of the Act, the Welsh Ministers, the Scottish Ministers and the Northern Ireland department(2) have consented to the making of these Regulations.

Citation, commencement and extent

regulation 1 1.—(1) These Regulations may be cited as the Ivory Prohibitions (Exemptions) (Process and Procedure) (Amendment) Regulations 2025.

(2) These Regulations come into force on 15th May 2025.

(3) These Regulations extend to England and Wales, Scotland and Northern Ireland.

Amendment to the Ivory Prohibitions (Exemptions) (Process and Procedure) Regulations 2022

regulation 2 2.—(1) The Ivory Prohibitions (Exemptions) (Process and Procedure) Regulations 2022(3) are amended as follows.

(2) In the Schedule (prescribed institutions), in paragraph 1, after sub-paragraph (i), insert—

(j)National Museums and Galleries on Merseyside;

(k)National Museums and Galleries of Northern Ireland;

(l)National Museum of Wales.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Schedule to the Ivory Prohibitions (Exemptions) (Process and Procedure) Regulations 2022 (S.I. 2022/94) to prescribe three additional institutions that the Secretary of State considers possess the necessary knowledge and expertise to provide him with advice on applications for exemption certificates under the Ivory Act 2018 (c. 30).

A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
