The Secretary of State makes these Regulations in exercise of the powers conferred by Articles 89(a) and 227(4) of Regulation (EU) No1308/2013 of the European Parliament and of the Council establishing a common organisation of the markets in agricultural products(1), and sections 38(5) and 50(3) of the Agriculture Act 2020(2).

In accordance with Section 39(2) of the Agriculture Act 2020, the Secretary of State has, where necessary, obtained the consent of the Welsh Ministers and the Scottish Ministers to the making of these Regulations.

Part 1Introductory

Citation, commencement and extent

regulation 1 1.—(1) These Regulations may be cited as the Common Organisation of the Markets in Agricultural Products (Marketing Standards and Organic Products) (Transitional Provisions) (Amendment) Regulations 2025.

(2) These Regulations come into force on 1st February 2025.

(3) These Regulations extend to Great Britain.

Part 2Amendments to assimilated legislation

Council Regulation (EC) No 834/2007

regulation 2 2.—(1) Council Regulation (EC) No 834/2007 on organic production and labelling of organic products(3) is amended as follows.

(2) In Article 33—

regulation 2 2 a (a)in paragraph 1, for “1 February 2025” substitute “1 February 2027”;

regulation 2 2 b (b)in paragraph 2, for “1 February 2025” substitute “1 February 2027”.

Commission Regulation (EC) No 543/2008

regulation 3 3.  In Article 14 of Commission Regulation (EC) No 543/2008 laying down detailed rules for the application of Council Regulation (EC) No 1234/2007 as regards the marketing standards for poultrymeat(4), for “1 February 2025” substitute “1 February 2027”.

Commission Regulation (EC) No 889/2008

regulation 4 4.  In Article 34 of Commission Regulation (EC) No 889/2008 laying down detailed rules for the implementation of Council Regulation (EC) No 834/2007 on organic production and labelling of organic products with regard to organic production, labelling and control(5), for “1st January 2021” substitute “1 February 2027”.

Commission Regulation (EC) No 1235/2008

regulation 5 5.—(1) Commission Regulation (EC) No 1235/2008 laying down detailed rules for implementation of Council Regulation (EC) No 834/2007 as regards the arrangements for imports of organic products from third countries(6) is amended as follows.

(2) In Article 13(1), for “1 February 2025” substitute “1 February 2027”.

(3) In Article 13b, for “1 February 2025” substitute “1 February 2027”.

(4) In Article 14(1), for “1 February 2025” substitute “1 February 2027”.

Commission Regulation (EC) No 1295/2008

regulation 6 6.—(1) Commission Regulation (EC) No 1295/2008 on the importation of hops from third countries(7) is amended as follows.

(2) In Article 1(2)(b), for “1 February 2025” substitute “1 February 2027”.

(3) In Article 3—

regulation 6 3 a (a)for “1 February 2025” substitute “1 February 2027”; and

Regulation (EU) No1308/2013 of the European Parliament and of the Council

regulation 7 7.—(1) Regulation (EU) No1308/2013 of the European Parliament and of the Council establishing a common organisation of the markets in agricultural products(11) is amended as follows.

(2) In Article 77(4), for “1 February 2025”, in both places it occurs, substitute “1 February 2027”.

(3) In Article 190(2), for “1 February 2025” substitute “1 February 2027”.

Part 3Amendments to subordinate legislation in respect of Great Britain

The Hops Certification Regulations 1979

regulation 8 8.—(1) The Hops Certification Regulations 1979(12) are amended as follows in respect of Great Britain.

(2) In regulation 3(1)—

regulation 8 2 a (a)in sub-paragraph (c)(ii), for “1 February 2025” substitute “1 February 2027”;

regulation 8 2 b (b)in sub-paragraph (d)(ii), for “1 February 2025” substitute “1 February 2027”;

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend transitional provisions in assimilated legislation and subordinate legislation, in respect of Great Britain, by extending the current transitional arrangements concerning the requirements that apply to imported products until 1st February 2027. In addition, regulation 6 also replaces references to legislation applicable in the EU, for the purposes of provisions under which imported goods may be certified to equivalent EU standards, so as to keep those references up-to-date following legislative changes within the EU and updates the contact information of the Australian Agency authorised to issue hops import certifications.

Part 2 of these Regulations amends assimilated legislation relating to organics and marketing standards for poultrymeat and hops. Part 3 of these Regulations amends subordinate legislation relating to the marketing of hops.

A full impact assessment has not been prepared for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
