EXPLANATORY NOTE
(This note is not part of the Regulations)
The Tertiary Education and Research (Wales) Act 2022 (“the 2022 Act”) abolishes the Higher Education Funding Council for Wales and creates the Commission for Tertiary Education and Research (“the Commission”).
Paragraph 29 of Schedule 4 to the 2022 Act amends the School Standards and Organisation (Wales) Act 2013 (“the 2013 Act”) in relation to school reorganisations. Those amendments include removing the Welsh Ministers’ powers to make proposals to restructure local authority maintained school sixth form education, instead giving the Commission powers to restructure sixth form education.
These Regulations make consequential amendments to primary and secondary legislation to reflect those amendments made to the 2013 Act by the 2022 Act.
The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to these Regulations. As a result, it was not considered necessary to carry out a regulatory impact assessment as to the likely costs and benefits of complying with this instrument.
