EXPLANATORY NOTE

The Trade in Animals and Related Products (Amendment and Legislative Functions) and Animal Health (Miscellaneous Amendments) (Wales) (EU Exit) Regulations 2022 (S.I. 2022/1348 (W. 271)) (“the 2022 Regulations”) addressed failures of assimilated law to operate effectively and corrected other deficiencies which arose from the withdrawal of the United Kingdom from the European Union and amended the Trade in Animals and Related Products (Wales) Regulations 2011 (S.I. 2011/2379 (W. 252)).

This Order corrects an error in the 2022 Regulations by amending the modification made to Directive 2009/156 to enable Orders made under section 10 of the Animal Health Act 1981 to determine the period in which Equidae may be dispatched from territories considered to be infected with African horse sickness.

The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to this Order. As a result, it was not considered necessary to carry out a regulatory impact assessment as to the likely costs and benefits of complying with this Order.
