Part 3Amendments to civil legal aid regulations

Amendments to the Civil Legal Aid (Procedure) Regulations 2012

article 5 5.—(1) In each of the following provisions of the Civil Legal Aid (Procedure) Regulations 2012(1), for “domestic violence” substitute “domestic abuse” in each place it occurs—

article 5 1 a (a)regulation 2, paragraphs (d) and (e) of the definition of “family dispute”;

article 5 1 b (b)regulation 23(2);

article 5 1 c (c)the heading of regulation 33;

article 5 1 d (d)regulation 33(1) and (2);

article 5 1 e (e)regulation 42(1)(k)(v), and (vi)(a) and (b);

article 5 1 f (f)the heading of Schedule 1;

article 5 1 g (g)Schedule 1, paragraphs 1, 2, 3, 4, 5, 8, 9, 10, 11, 12, 13, 14, 16(a) and (c), 17(1),(2)(c) and (3)(a), 18, 19, 20, 21 and 22.

(2) In Schedule 1—

article 5 2 a (a)in paragraph 20 after “granted” insert “leave to enter or”;

article 5 2 b (b)in paragraph 21, for “financial” substitute “economic”;

article 5 2 c (c)in paragraph 22, in the definition of “appropriate health professional”—

article 5 2 c i (i)at the end of sub-paragraph (b) omit “or”;

article 5 2 c ii (ii)at the end of sub-paragraph (c) insert “or”;

article 5 2 c iii (iii)after sub-paragraph (c) insert—

(d)a medical practitioner, nurse, midwife, dental practitioner, paramedic, practitioner psychologist, radiographer or social worker registered and licensed to practise in the country in which they provide a letter or report, or examine A under this Schedule;.
