The Secretary of State makes these Regulations in exercise of the powers conferred by sections 1(1) and (3), 2(1) and (3), 5(2) and (4) and 7(1)(g) of the Export Control Act 2002(1) and Article 15(1) of Council Regulation (EC) No 428/2009 of 5 May 2009 setting up a Community regime for the control of exports, transfer, brokering and transit of dual-use items (Recast)(2).
