Transitional provision

regulation 17 17.—(1) Paragraph (2) applies in relation to each licence issued by the Secretary of State which—

regulation 17 1 a (a)was in effect immediately before the operative day; and

regulation 17 1 b (b)authorises an act which would otherwise be prohibited, on and after the operative day, by Chapter 4, 4H, 4M, 6 or 6B of Part 5 (Trade) of the 2019 Regulations,

term existing licence and such a licence is referred to in this regulation as an “existing licence”.

(2) A licence is deemed to have been issued by the Secretary of State at the beginning of the operative day under regulation 65 (Trade licences) of the 2019 Regulations, disapplying every provision of Part 5 of the 2019 Regulations which would, in the absence of this paragraph, prohibit a relevant act.

(3) In this regulation—

term the 2019 regulations the 2019 Regulations” means the Russia (Sanctions) (EU Exit) Regulations 2019;

term the operative day the operative day” means the day on which these Regulations come into force;

term relevant act relevant act” means an act specified in paragraph (4).

(4) The relevant acts for the purposes of this regulation are the transfer or making available of the minimum software and technology, or the direct or indirect provision of services required, for—

regulation 17 4 a (a)the installation, maintenance, operation and repair of the goods specified in the existing licence; or

regulation 17 4 b (b)the direct or indirect provision of the services specified in the existing licence.
