SCHEDULE 11DEEMED MARINE LICENCE UNDER THE 2009 ACT—GENERATION ASSETS
PART 2CONDITIONS
Maintenance of the authorised scheme
schedule 11 part 2 paragraph 3 3.—(1) No less than four months prior to the completion of construction of the authorised scheme the undertaker must submit to the MMO for approval an operations and maintenance plan which accords with the outline offshore operations and maintenance plan.
(2) The undertaker may at any time maintain the authorised scheme, except to the extent that this licence or an agreement made under this licence provides otherwise. All operation and maintenance activities must be carried out in accordance with the approved operations and maintenance plan unless otherwise agreed in writing between the undertaker and the MMO.
(3) No maintenance works whose likely effects are not assessed in the environmental statement may be carried out, unless otherwise approved by the MMO.
(4) Maintenance works include but are not limited to—
schedule 11 paragraph 3 4 a (a)major wind turbine component or offshore substation platform replacement;
schedule 11 paragraph 3 4 b (b)painting wind turbine generators or offshore substation platforms;
schedule 11 paragraph 3 4 c (c)bird waste removal;
schedule 11 paragraph 3 4 d (d)cable remedial burial;
schedule 11 paragraph 3 4 e (e)array cable repairs;
schedule 11 paragraph 3 4 f (f)access ladder replacement;
schedule 11 paragraph 3 4 g (g)wind turbine generator anode replacement; and
schedule 11 paragraph 3 4 h (h)J-tube repair/replacement.
(5) Where the MMO’s approval is required under paragraph (3), approval may be given only where it has been demonstrated to the satisfaction of the MMO that the works for which approval is sought are unlikely to give rise to any new or materially different effects from those assessed in the environmental statement.
