SCHEDULE 14PROTECTIVE PROVISIONS

PART 10FOR THE PROTECTION OF PORT OF TILBURY LONDON LIMITED

Permitting

schedule 14 paragraph 143 + 143.—(1) The undertaker must consult PoTLL before—

schedule 14 paragraph 143 1 a + (a)applying for a new permit, a variation of an existing permit or a surrender of an existing permit under the Environmental Permitting (England and Wales) Regulations 2016(1);

schedule 14 paragraph 143 1 b + (b)applying to surrender an existing permit under article 68 (interface with waste operation permits); or

schedule 14 paragraph 143 1 c + (c)submitting an environmental scheme under article 68 (interface with waste operation permits),

which applies or will apply to activities in the Port, and must have regard to PoTLL’s comments in finalising those applications or submissions.

(2) Within the Port, the meaning of “authorised activity” in article 68 is to be construed as including the carrying out of any preliminary works.
