Maintenance of authorised development

article 5 + 5.—(1) The undertaker may at any time maintain the authorised development, except to the extent that this Order or any agreement under this Order provides otherwise.

(2) Paragraph (1) does not apply to the highway works the maintenance of which is governed by article 15 (maintenance of highway works) and Parts 5 and 6 of Schedule 15 (protective provisions).
