Explanatory Note

These Regulations amend the Civil Legal Aid (Remuneration) Regulations 2013 (S.I. 2013/422) (“the Remuneration Regulations”). The Remuneration Regulations make provision about payment by the Lord Chancellor to providers of legal services under arrangements made for the purposes of Part 1 of the Legal Aid, Sentencing and Punishment of Offenders Act 2012 (c.10).

Regulation 2 of these Regulations removes paragraph 2A, amends Table 1 and removes Table 7 in Part 1 of Schedule 1 to the Remuneration Regulations. The effect of this on the remuneration of civil legal services for welfare benefits is that, for Controlled Work (legal help and help at court), the applicable standard fee is £208 and provision is made for an escape fee threshold of £624. Regulation 3 provides that these changes do not apply to a case where the application for civil legal services is signed on a date before these Regulations come into force.
