Amendment of Regulation (EU) 2016/403
regulation 4 4.—(1) Annex I to Commission Regulation (EU) 2016/403 of 18 March 2016 supplementing Regulation (EC) No 1071/2009 of the European Parliament and of the Council with regard to the classification of serious infringements of the Union rules, which may lead to the loss of good repute by the road transport operator, and amending Annex III to Directive 2006/22/EC of the European Parliament and of the Council(1) is amended as follows.
(2) In the table comprising Section 1 (Groups of infringements against Regulation (EC) No 561/2006 of the European Parliament and of the Council (Driving and resting time))—
regulation 4 2 a (a)omit the sub-heading “12-day rule derogation”;
regulation 4 2 b (b)omit rows 29, 30 and 31.
(3) In the table comprising Section 2 (Groups of infringements against Regulation (EU) No 165/2014 of the European Parliament and of the Council (Tachograph))—
regulation 4 3 a (a)in row 21, for the entry in the third column (Type of infringements) substitute—
| “Unable to produce records of current day and the previous 28 days or 56 days, whichever is applicable”; |
regulation 4 3 b (b)in row 23, for the entry in the third column (Type of infringements) substitute—
