PART 2PROCEDURE FOR DISCHARGE OF REQUIREMENTS

Applications made under requirements

schedule 2 paragraph 29 + 29.—(1) Where an application has been made to the discharging authority for any consent, agreement or approval required by a requirement (including consent, agreement or approval in respect of part of a requirement) included in this Order—

schedule 2 paragraph 29 1 a + (a)the undertaker must give the discharging authority sufficient information to identify the requirement(s) to which the application relates;

schedule 2 paragraph 29 1 b + (b)the undertaker must provide such particulars, and the request be accompanied by such plans and drawings as are reasonably considered necessary to deal with the application.

(2) The discharging authority must give notice to the undertaker of the decision on the application before the end of the decision period.

(3) For the purposes of sub-paragraph (2), the decision period is—

schedule 2 paragraph 29 3 a + (a)where no information is requested under paragraph 31 (further information), 8 weeks from the day immediately following that on which the application is received by the discharging authority;

schedule 2 paragraph 29 3 b + (b)where further information is requested under paragraph 31 (further information), 8 weeks from the day immediately following that on which further information has been supplied by the undertaker under paragraph 31; or

schedule 2 paragraph 29 3 c + (c)such longer period as may be agreed between the undertaker and the discharging authority in writing before the end of the period in sub-paragraph (a) or (b).

(4) In determining any application made under sub-paragraph (1), the discharging authority may—

schedule 2 paragraph 29 4 a + (a)give or refuse its consent, agreement or approval; or

schedule 2 paragraph 29 4 b + (b)give its consent, agreement or approval subject to reasonable conditions,

and where consent, agreement or approval is refused or granted subject to conditions the discharging authority must provide its reasons for that decision with the notice of the decision pursuant to sub-paragraph (2).
